Terms of Use
1. About these Terms
These Terms of Service ("Terms") govern your use of halalautofinancingedmonton.ca (the "Site") and any services, forms, or communications offered through it (together, the "Services"), operated by Halal Auto Financing Edmonton ("we," "us," "our"). By using the Site, submitting a form, or contacting us, you agree to these Terms. If you do not agree, do not use the Site.
2. What we do
We help people in Edmonton and the surrounding area obtain Shariah-compliant, interest-free (no riba, no compounding) financing for new and used vehicles. Financing is arranged with participating Edmonton-area dealerships and financing partners and is subject to their approval. We do not sell vehicles and we do not issue final credit decisions.
3. Eligibility
To use the Services you must:
- be at least 18 years old (the age of majority in Alberta);
- be a resident of Alberta or the service area we cover;
- have the legal capacity to enter into a contract; and
- provide accurate, current, and complete information.
4. No guarantee of approval
Submitting a form or speaking with us does not create any obligation on our part or any guarantee that financing will be offered or approved. Vehicle availability, pricing, financing structure, and approval are determined by the participating dealership or financing partner, subject to their criteria and to documentation and verification.
5. Not professional advice
Content on the Site — including material about Murabaha, Ijarah, the cost of riba, and what to check on a used vehicle — is provided for general education only. It is not financial, legal, tax, or religious advice, and it is not a substitute for advice from a qualified professional or scholar for your situation. You are responsible for satisfying yourself that any financing arrangement meets your own requirements.
6. Your responsibilities
You agree to:
- provide truthful and accurate information;
- use the Site only for lawful purposes;
- not submit another person's information without their permission;
- not attempt to interfere with, disrupt, or gain unauthorized access to the Site or its systems; and
- not use the Site to send spam or automated queries.
7. Communications and consent
By providing your phone number, email address, or other contact details, you agree that we and the dealerships and financing partners working on your inquiry may contact you by phone, text message, and email about that inquiry, including by automated dialing or messaging systems. Consent to marketing messages is not a condition of obtaining any product or service. Message and data rates may apply. You can opt out of text messages at any time by replying STOP, and out of marketing emails by using the unsubscribe link or contacting us. We may still send you non-marketing messages about an active inquiry.
8. Intellectual property
The Site and its content — text, graphics, logos, and layout — are owned by or licensed to us and are protected by Canadian and international intellectual property laws. You may view and print pages for your own personal, non-commercial use. You may not copy, republish, or distribute Site content without our written permission.
9. Third-party links and services
The Site may link to third-party websites or services, including dealerships and financing partners. We do not control and are not responsible for their content, products, or privacy practices. Your dealings with any third party are solely between you and that third party.
10. Disclaimer of warranties
The Site and Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that any information on it is complete or current.
11. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or opportunity, arising out of or related to your use of the Site or Services, even if we have been advised of the possibility of such damages. To the fullest extent permitted by law, our total liability for any claim relating to the Site or Services will not exceed CAD $100. Nothing in these Terms limits liability that cannot be limited under applicable law.
12. Indemnification
You agree to indemnify and hold us harmless from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Site, your breach of these Terms, or your violation of any law or the rights of a third party.
13. Changes to the Site and Terms
We may change, suspend, or discontinue any part of the Site at any time. We may also update these Terms from time to time. Changes take effect when we post the updated Terms with a new "Last updated" date. Your continued use of the Site after that means you accept the changes.
14. Governing law
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts located in Alberta for any dispute that is not otherwise resolved.
